These Terms of Service ("Terms") govern your use of the Walkalyze iOS application ("Walkalyze" or the "App"), provided by Digital Mundo LLC ("Digital Mundo," "we," "us," or "our"). By downloading or using Walkalyze, you agree to these Terms and the Walkalyze Privacy Policy. If you do not agree, do not use the App.
1. What Walkalyze provides
Walkalyze reads your workouts and workout routes from Apple Health and shows them on a map, with exploration statistics such as map tiles visited and distance covered on new ground. Walkalyze is free.
2. Personal, lawful use
You may use Walkalyze for personal purposes that are lawful. You may not misuse the App, interfere with its operation, or use it to violate another person's rights.
3. Your data
Your workouts and routes belong to you and remain in Apple Health. Walkalyze only reads them, and keeps a copy on your device to display them. We cannot access or recover your data.
4. Not a medical or navigation tool
Walkalyze is for fun and personal insight. Its maps and statistics depend on GPS recordings and are estimates that can be inaccurate. Do not rely on Walkalyze for medical decisions, navigation, or safety. Be aware of your surroundings and obey local laws when walking, running or exploring, and do not enter private or unsafe places to visit a map square.
5. Third-party services
Maps and place names are provided by Apple Maps, and health data by Apple Health, under Apple's own terms. We do not control and are not responsible for third-party services or their availability.
6. Our intellectual property
The Walkalyze name, logo, and App are owned by Digital Mundo. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the App in accordance with these Terms.
7. Availability and changes
We may update, change, suspend, or discontinue features to maintain or improve Walkalyze, address security or legal requirements, or reflect changes in iOS or third-party services.
8. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, WALKALYZE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DIGITAL MUNDO AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR OPPORTUNITIES, ARISING FROM OR RELATED TO WALKALYZE. Nothing in these Terms excludes liability that cannot legally be excluded.
10. Termination
You may stop using Walkalyze at any time by deleting it. Provisions that by their nature should survive, including ownership, disclaimers, and liability limitations, will survive.
11. Apple terms
Your use of Walkalyze is also subject to the applicable Apple Media Services terms and Apple's standard App Store license terms. Apple is not responsible for Walkalyze's content, maintenance, or support.
12. Governing law
These Terms are governed by the laws of the State in which Digital Mundo LLC is organized, without regard to conflict-of-law rules, except to the extent the law where you live requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the effective date. Your continued use of Walkalyze after updated Terms take effect means you accept them.
